These terms govern the working relationship between WandUp and our clients. By engaging our services, you agree to the following. As always — written in plain English.
WandUp agrees to deliver the services outlined in your project proposal — which may include website design and development, mobile app development, local SEO, analytics, booking integration, or any combination of these. The exact scope, deliverables, and timeline will be confirmed in writing before work begins.
Any additions or changes to the agreed scope of work must be discussed and approved in writing by both parties. Changes may affect the project timeline and pricing. We will always notify you before proceeding with work that falls outside the original agreement.
All projects require a 40–50% upfront deposit before work commences. This is non-negotiable and protects both parties. The deposit confirms your commitment to the project and allows us to allocate team resources.
The remaining balance is due upon project completion — before the final deliverable (website, app, etc.) is handed over or deployed to your domain. We'll send an invoice with clear payment instructions.
If payment is delayed beyond 7 days of the due date without prior communication, we reserve the right to pause work on your project until the balance is settled.
The upfront deposit is non-refundable once work has begun. If you decide to cancel after work has started, you are liable for the cost of work completed up to that point. We will provide a detailed account of work completed before any final settlement.
Any content, images, logos, or brand materials you provide to us remain your property. You grant WandUp a license to use them solely for the purpose of delivering your project.
Once final payment is received, full ownership of the completed deliverable (website, app, design files) transfers to you. Until payment is received in full, WandUp retains ownership of all work produced.
We reserve the right to feature your completed project in our portfolio and case studies unless you explicitly request otherwise in writing before project commencement.
We commit to the timeline agreed in your project proposal. We provide weekly progress updates and flag any potential delays proactively — never after the fact.
Timelines depend on timely feedback and content from your side. If you're unavailable for approvals or delay providing required materials (text, images, access credentials), the project timeline will adjust accordingly. WandUp is not responsible for delays caused by the client.
Neither party is liable for delays caused by circumstances beyond their control — including illness, technical outages, or other unforeseen events. We will communicate any such situation as early as possible.
Every project includes 1–2 rounds of revisions after the first design or development draft is shared. A revision round means consolidated feedback addressed in one go — not an open-ended series of individual changes.
Revisions beyond the included rounds will be quoted and billed separately. We'll always give you an estimate before proceeding.
After launch, we provide a 14-day free bug-fix period. This covers technical issues caused by our work — not new feature requests or content changes. After 14 days, support is available via a monthly maintenance plan.
WandUp's total liability for any claim arising from our services is limited to the total amount you paid us for the project in question. We are not liable for any indirect, incidental, or consequential damages including loss of revenue, data, or business opportunity.
We may recommend or integrate third-party tools (hosting, analytics, booking platforms, etc.). We are not responsible for the availability, pricing changes, or terms of these services. Any costs associated with third-party tools are your responsibility unless explicitly included in your project quote.
You are responsible for the accuracy and legality of all content published on your website or app. WandUp is not liable for any claims arising from content supplied by the client.
You may cancel the project at any time by notifying us in writing. You will be invoiced for all work completed up to the date of cancellation. The upfront deposit is non-refundable.
We reserve the right to terminate a project if a client engages in abusive, threatening, or unethical behaviour toward our team, or if payment obligations are not met. In such cases, completed work to date will be invoiced and the remaining deliverables will not be released.
These terms are governed by the laws of India. Any disputes arising from these terms or our services will be resolved under Indian jurisdiction, with Bhopal, Madhya Pradesh as the agreed venue.
WandUp may update these Terms of Service from time to time. We will notify active clients of any material changes. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
